This Service Prepayment Top-Up Specification (the “Top-Up Specification”) records each top-up by the Customer of the Service Prepayment held in the Customer’s Account. It applies in respect of both the Mining Hardware Hosting Agreement and the Mining Service Agreement (together, the “Service Agreements”), and supplements the Order Specification(s) entered into under those agreements. In the event of any conflict between this Top-Up Specification and the applicable Service Agreement, the Service Agreement shall prevail.
This Top-Up Specification does not constitute a new contract and does not amend the principal Service Agreements. It records a financial transaction by which the Customer makes an advance payment in respect of future Hosting Fees and/or Service Fees pursuant to § 6 of the Mining Hardware Hosting Agreement and/or § 6 of the Mining Service Agreement.

By submitting this top-up, the Customer confirms that the Customer:- has reviewed the version in effect of the applicable Service Agreement(s) and confirms that the terms governing the Service Prepayment (§ 6 of the Mining Hardware Hosting Agreement and/or § 6 of the Mining Service Agreement) remain unchanged;
- understands that the Service Prepayment is an advance payment exclusively on account of a specific hosting service or Service Package operation provided by Cuverse, and does not constitute the holding of Customer funds, a deposit, electronic money (e-money) or a payment service;
- understands that the Service Prepayment is debited daily against accrued Hosting Fees and/or Service Fees;
- (where the top-up is made in cryptocurrency) understands that the cryptocurrency amount is immediately converted into its USD equivalent at the applicable exchange rate and is recorded as Service Prepayment in USD; following such conversion, the Customer is not entitled to require a refund in the original cryptocurrency at the original exchange rate;
- understands that any refund of the Service Prepayment, where applicable, is governed by the Cuverse Refund Policy, including the rules on the currency of refund, payment provider fees and outstanding amounts owed;
- understands that this Top-Up Specification does not extend, renew or modify the Service Period or the Term of any existing contract.
